Workers’ Compensation
 
The law firm of Babcock, Mannella & Klint P.L.L.P. has handled thousands of injured workers cases. Besides understanding the complex legal nature of a workers’ compensation matter, because of personal experience the firm understands the more personal concerns an injured worker may have.
 
Since the Workers’ Compensation Law in Minnesota is ever changing, literally weekly, attorneys practicing in this area must be kept abreast of the changes. Our Workers’ Compensation Department reviews and analyzes approximately 30 Workers’ Compensation Court of Appeals and Minnesota Supreme Court decisions a month so as to properly keep our clients advised. It is no longer possible for this complex area of law to have an attorney who practices “occasionally” to represent an injured worker.
 
The fees in workers’ compensation matters are handled similar to fees in a personal injury case. They are handled on a contingency basis. This means there is no fee charged unless benefits are recovered. In addition, there is no fee for a consultation regarding your case to determine if representation is necessary.

Long Term/Short Term Disability
 
It is important to remember that Long Term Disability and Short Term Disability benefits do not require an individual’s disability to have been caused by a work-related injury. Long Term and Short Term Disability policies pay when you are unable to work because of ongoing disability. Just because you were denied does not mean you will not qualify, you have the right to appeal the denial decision or to bring a lawsuit to recover benefits.
 
Long Term Disability and Short Term Disability benefits are payable through an employer, through a self-insured plan, or through a group insurance policy. Benefits are not state mandated and are strictly contractual in nature. Disability definitions differ under each plan and are not defined by any local, state or federal agency. Family Law
 
The Family Law Department represents clients with regard to marital dissolution actions (divorce), step parent adoptions, paternity proceedings, post decree proceedings to modify child support, custody, parenting time schedules, spousal maintenance, satisfaction of disputes regarding real estate in divorce, parenting time expeditor services and parenting consulting services.
 
As part of our family law services, we also provide alternative forms of dispute resolution including mediation and arbitration services by a qualified mediator and arbitrator who has been conducting mediations since 1989. The family law mediator can assist both parties as a neutral expert to achieve a settlement without contested and expensive court trial proceedings. Mediation services can be used to achieve a settlement with regard to any issues that arise in family law. The mediator can also help parties resolve issues in matters which are outside of the family law area.
 
Our goal is to provide our clients with skilled legal representation in order to assure that all of their rights and interests are protected.
 
While protecting our client’s interests, we also recognize the overall needs of the family in promoting healthy co-parenting and parent-child relationships even in the face of pending dissolution, paternity or post decree proceedings.
